This is a question posed to the muhaddith of this era Ash-Shaykh Muhammad Nasruddin Al Albani may Allah be merciful to him.

Q: I read in (the book) “Description of the Prophet’s Fasting During Ramadan” authored by Saleem Al Hilaali wherein he states the pregnant woman and the one nursing and or suckling if they fear (harm) for themselves or their child they can break their fast and feed a poor person each day (in place of the fasting days missed), and that it isn’t binding upon them to make up those days. Is this statement correct?

A: It isn’t compulsory for them to make up the days, on the contrary the feeding of a poor person it (alone) is. This is the correct answer. As for the previously mentioned condition, that being if they fear (harm) for themselves or their child, this condition is solely based on the ijtihad of some scholars that neither the pregnant woman nor the one nursing and or suckling have been burdened with. That’s because the Prophet -sallahu alayhi wa salaam- said, “Indeed Allah has lifted (the obligation) of fasting from the pregnant woman and the one nursing and or suckling.” 

Furthermore Ibn Abbas said in his explanation  Concerning Allah’s statement:

…و على الَّذين يُطيقونه فِديةٌ طعامُ مسكين...

“…and whoever has difficulty (with fasting) they feed a poor person…” (Al-Baqarah: 184)

“The pregnant woman and the one nursing and or suckling feeds (a poor person).”And so the previously mentioned condition (of fear for themselves or their child) is not present.

Thus the conclusion is that it is permissible for every pregnant woman and every woman nursing and or suckling to break her fast and feed a poor person (during each missed day), and there is no making up of the days, just this (the feeding).

The following question was presented to the world renowned scholar of fiqh Ash-Shaykh Muhammad ibn Salih Al Uthaymin may Allah be merciful to him.

Q: Does every (single) day that is fasted during Ramadan necessitate a (renewed) intent or is it sufficient to intend to fast the entire month?

A: One intention at the beginning of Ramadan is sufficient. That’s because the fasting person if he does not renew his intent each day (the night before) then surely that was his intent at the beginning of the month. However if there is a break in fasting during the month due to traveling or sickness and whatever is similar to that, then renewal of  the intention is made binding upon him, due to the intent being broken by abandonment of the fast due to traveling or a sickness etc.

Q: What is the ruling concerning he who fasts and prays whenever Ramadan arrives, yet when it concludes he abandons prayer?

A: That which has been made clear to me by way of evidence is that whomsoever abandons the prayer is not deemed a disbeliever unless he abandons it in totality (he never prays). As for he who prays on some occasions and leaves it off on other occasions, he doesn’t disbelieve as a result of that based on that which is clear to me from the evidence. This is due to the Prophet’s -sallahu alayhi wa salaam- statement: “The distinguishing between us and them is the prayer whoever abandons it disbelieves.” and his statement: “(that which stands) Between a man and between polytheism and disbelief is the abandonment of prayer.“

However the person who doesn’t pray except in Ramadan along with fasting (this person) I have doubt with regards to his faith, by virtue of the fact that if he were a true believer he would pray in Ramadan and in other months. As for him not being cognizant of his lord except during Ramadan it causes me to doubt his faith, yet I do not pass a ruling of disbelief (upon this individual). On the contrary; I’m hesitate concerning him and his affair is with Allah.

A question posed to the former Mufti of Saudi Arabia, the firmly grounded scholar Abdul Aziz ibn Baz may Allah bestow His mercy upon him.

Q: What is the ruling with regards to voluntary fasts like the six days of Shawwal, the ten days of dhil-hijjah, the tenth day of Muharram etc for he who has days of Ramadan that he has yet to complete?

A: It’s obligatory upon those that have days of Ramadan to complete to begin with them before doing that which is voluntary due to obligatory actions being of greater importance than voluntary according to the more correct statement of the people of knowledge.
